Post-Brexit Immigration Rules for EEA & Swiss Nationals

Following the UK’s exit from the European Union, free movement has ended, and new immigration rules apply to EEA and Swiss nationals.

If you’re from the EU, EEA, or Switzerland, your rights to live, work, and settle in the UK depend on when you arrived, your status, and your relationship to other EU nationals.

RNW Solicitors is here to ensure you follow the correct legal route and avoid common pitfalls.

If You Were Living in the UK by 31 December 2020

If you were legally residing and working in the UK by 31 December 2020, you should apply to the:

EU Settlement Scheme (EUSS)
This grants either Pre-Settled or Settled Status, allowing you to continue living and working in the UK.

We help you:

  • Check your eligibility

  • Apply with proper documentation

  • Convert from Pre-Settled to Settled Status later

  • Challenge refusals or delays

Family Members of EEA Nationals

If you are a close family member (e.g. spouse, child, dependent parent) of an EEA national who was living in the UK before 31 December 2020, and your relationship existed before that date, you may qualify for the:

EU Settlement Scheme Family Permit

This allows you to join your EEA family member in the UK and later apply for the Settlement Scheme yourself.

We assist with:

  • Eligibility assessments

  • Gathering supporting evidence

  • Submitting Family Permit applications

  • Appeals if a permit is refused

Coming to the UK After Brexit

If you’re an EEA or Swiss national who wishes to move to the UK now, you no longer have automatic rights. You’ll need to apply under the UK’s points-based immigration system, typically via a:

UK Work Permit (Skilled Worker Visa)

This visa requires:

  • A confirmed job offer from a UK employer

  • English language skills

  • Salary meeting the minimum threshold

  • Certificate of sponsorship

We provide end-to-end legal help with work visa applications.
