What is Immigration Bail?
If you are being held in immigration detention by the Home Office, you may be able to apply for immigration bail — a form of conditional release while your immigration case is ongoing.
Bail can be granted by either the Home Office or the First-tier Tribunal (Immigration and Asylum Chamber), depending on your case.
It is not an automatic right — your case must show that there is a good reason for release, and that you will comply with the conditions set.
Who Can Apply for Immigration Bail?
You may be eligible to apply for immigration bail if:
You are currently being held in an immigration removal centre or detention facility
You have a fixed address in the UK where you can stay
You are not considered a risk of absconding or re-offending
There is a responsible person (surety) who can vouch for your compliance
RNW Solicitors can assess your eligibility, prepare your application, and represent you at a bail hearing if needed.
Bail Conditions
If granted, immigration bail may come with certain legal conditions, such as:
📍 Staying at a specific address
🕒 Reporting regularly to a police station or immigration office
📵 Restrictions on work or travel
🤝 Compliance with immigration procedures and future hearings
Failure to follow these conditions can result in re-detention, so it’s crucial to understand them fully.
